Residency “Tarjeta de Identidad de Extranjero”

The Foreigner Identity Card will be issued only to foreigners in a legal situation in Spain, according to the general immigration or community regime. The Foreigner Identity Card will be requested by those who have been issued a visa or an authorization to remain in Spain for a period exceeding six months, in the event of renewal of such authorization, when there is a change in the situation or change of data of the Card and in the cases in which it has been stolen, lost, destroyed or unused. For its expedition, the government’s prior resolution to grant the corresponding administrative authorization or, as the case may be, recognition of the right to remain in Spanish territory, as well as the previous payment of the legally established tax rates, will be indispensable requisites.

 

Obligations of the holder


All foreigners who have been issued a visa or authorization to remain in Spain for a period of more than six months have the right and duty to obtain the Foreigner Identity Card (TIE), which they must personally request within one month after entering in Spain or after the authorization has been granted or is valid, respectively. Holders of a residence permit and seasonal work will be exempt from this obligation.

Holders of the Foreigner Identity Card are obliged to carry this document with them, as well as to exhibit it when it is required by the Authority or its agents, without prejudice to proving their identity through their valid passport or similar document.

In case of lost, destruction or disabling of the Foreigner Identity Card, the holder is obliged  to request immediately a new document which will have the same validity as the lost, destroyed or unused one.

Foreigners who have the Foreigner Identity Card are obliged to inform changes of nationality, habitual residence, as well as the modifications of family circumstances or any other order that affect the data included in the aforementioned document. This needs to be done within one month, personally at the Police Station or the police services in the Foreigners Offices, corresponding to the place where they reside, unless they are required to do so, in which case they must communicate said circumstances within a period of fifteen days to count from the requirement. Those foreigners who enjoy refugee status and are domiciled in Madrid must complete the above obligations before the police services of the Asylum and Refuge Office in that city.

 

Place of presentation


The application for a Foreigner Identity Card needs to be presented personally at the foreigner office “Extranjeria” or in case not present at the National Police Station of the province where his domicile is established.

 

Documentation


In all cases, the application needs to be done by an official form (EX-17), original and copy, duly completed and signed by the foreigner.

The original documents needs to be presented, which will be returned once the copies have been checked.

 

Initial application TIE:

  • Passport or travel document with the entry stamp, sign or control mark made at the border post. In case this entry declaration is missing it must be applied in person at any police station or Foreigners Office within a maximum period of 72 hours from the time of entry into Spain; or, if applicable with registration certificate in force.
  • Three recent photographs, in color, on white background, card size.
  • Visa, if applicable.
  • Resolution granting the authorization that justifies the issuance of the card (unless the interested party consents to the verification of said information by the General State Administration).
  • Proof of the payment of the corresponding rate (s).
  • Accreditation of affiliation and / or registration in Social Security, if applicable.

 

Card renewals TIE:

  • Passport or travel title or, in case it may be, valid registration card.
  • Three recent photographs, in color, on white background, card size.
  • Resolution granting the authorization that justifies the issuance of the card (unless the interested party agree to the verification of such information by the General State Administration).
  • Proof of the payment of the corresponding rate (s).
  • Accreditation of affiliation and / or registration in Social Security, if applicable.

 

Duplicate in case for theft, loss, destruction or disablement:

  • Report of the loss or theft, or presentation of the unused card.
  • Passport or travel travel document or, in case it may be, valid registration card.
  • Three recent photographs, in color, on white background, card size.
  • Payment of the corresponding fee.

 

Assumption of modification of the situation or change of card data:

  • Passport or travel document or, in case it may be, valid registration card.
  • Three recent photographs, in color, on white background, card size.
  • Documentation accrediting the circumstances that imply the modification of the situation or the change of data of the card.
  • Payment of the corresponding fee.
  • Accreditation of affiliation and / or registration in Social Security, if applicable.
